General Terms and Conditions


II.1. Geltungsbereich

II.1.1. For all contracts concluded via the auction platform www.egun.de (hereinafter referred to as "egun") between us, the company Collector - Guns NL Verl and you (hereinafter also "Customer"), exclusively the following General Terms and Conditions ("AGB") in the version valid at the time of order or auction shall apply. The customer declares his agreement with the validity of these GTC upon placing a bid, but at the latest upon ordering or auctioning goods via egun. These are the subject matter of the contract.  

 
II.1.2. The product offer on egun is aimed equally at consumers and entrepreneurs. For the purposes of these GTC, (i) a consumer is any natural person who concludes the contract for a purpose that cannot be attributed to their commercial or self-employed professional activity (§ 13 BGB) and (ii) an "entrepreneur" is a natural or legal person or a legally capable partnership that acts in the exercise of their commercial or self-employed professional activity when concluding the contract (§ 14 Abs. 1 BGB).

 

II.2. Order Placement and Contract Formation

Our product offers on egun represent a non-binding invitation to place a binding order or bid for goods at Firma Collector - Guns NL Verl. By clicking on a button such as "Immediate Purchase", "Place Bid!", etc., the customer submits a binding offer to purchase the described goods. Collector - Guns NL Verl will immediately confirm the receipt of the customer's order or bid. This automatically generated confirmation of receipt does not constitute acceptance of the offer. The contract with Collector - Guns NL Verl only comes into effect through a separate order confirmation from us by e-mail or through the delivery of the goods (acceptance). Consequences of the revocation

If you withdraw from this contract, we will reimburse to you all payments we have received from you, including the costs of delivery (except for the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You must only pay for any depreciation in value of the goods if this depreciation in value is due to handling of the goods that is not necessary to check the condition, properties and functionality of the goods.

II.4. Eigentumsvorbehalt

Until full payment is received, the goods delivered to the customer remain the property of Collector - Guns NL Verl ("reserved goods"). The customer may not sell or pledge this reserved goods to third parties and must handle it properly and with care. The customer must notify us immediately of any third-party access to the reserved goods upon becoming aware of it. The customer is liable for all costs incurred to lift such access, in particular by filing a third-party opposition action, insofar as the costs are not recoverable from the third party concerned.

II.5. Gewährleistung

II.5.1. If the delivered goods are defective, the customer can initially demand from us the elimination of the defect or the delivery of defect-free goods; if the customer is an entrepreneur, we can choose between the elimination of the defect or the delivery of a defect-free item. The choice can only be made by notifying the customer in text form (including by e-mail) within three working days of notification of the defect. We can refuse the type of supplementary performance chosen by the customer if it is only possible at disproportionate cost.

II.5.2. If the subsequent performance according to Clause 5.1 fails or is unreasonable for the customer or we refuse the subsequent performance, the customer is entitled, in each case according to the applicable law, to withdraw from the purchase contract, reduce the purchase price or claim damages or compensation for their futile expenses. For the customer's claims for damages, the special provisions of Clause 6 of these GTC also apply.

II.5.3. The warranty period is two years and one year from delivery for used goods, if the customer is a consumer, otherwise one year from delivery.

II.5.4. Only for entrepreneurs, the following applies: The customer must examine the goods carefully immediately after sending. The delivered goods are considered approved by the customer if a defect is not notified to us (i) in the case of obvious defects within five working days after delivery or otherwise (ii) within five working days after discovery of the defect.

 

II.6. Haftung

II.6.1. Collector - Guns NL Verl is liable without limitation

                  - in case of intent or gross negligence,
                  - for the violation of life, body or health

II.6.2. Without prejudice to the provision in Section 6.1, Collector - Guns NL Verl is liable for negligence only in the case of breach of contractually essential obligations, i.e., the breach of obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer may regularly rely ("cardinal obligation"). In the case of a slightly negligent breach of a cardinal obligation, the liability of Collector - Guns NL Verl is limited to such typical damages and/or such typical extent of damages that were foreseeable at the time of the conclusion of the contract.

II.6.3. The above limitations of liability also apply in the event of fault by an agent of Collector - Guns NL Verl, as well as for the personal liability of employees and representatives of Collector - Guns NL Verl.

II.6.4. Die Verjährung von Schadensersatzansprüchen des Kunden aufgrund Haftung wegen Vorsatzes bemisst sich nach den gesetzlichen Vorschriften. II.7. Datenschutz

II.8.Prices and Payment

II.8.1. Unless another price has been explicitly agreed upon in an individual case, all deliveries from Collector - Guns NL Verl are based on the prices mentioned on egun on the day of the order or auction. Our prices include the statutory value added tax (either including 19% statutory VAT or differential taxation-
subject to § 25a USTG). The shipping costs mentioned in the order or auction are added to this. Customs duties and similar charges are to be borne by the customer.

II.8.2. We deliver to regular customers on account (sent via email and may also be included in our acceptance). Invoices are due immediately upon receipt by the customer and must be paid in full and without deduction within a maximum of seven days to the account specified in the invoice of Collector - Guns NL Verl.
 
II.8.3. We reserve the right to only accept prepayment or cash on delivery for first-time orders.

II.8.4. The customer is not entitled to set-off or retention rights, unless the counterclaim is undisputed or legally established.

 

II.9. Shipping of the goods

II.9.1. We will ship the goods to the customer no later than the shipping date specified at the time of the order or auction on the respective offer page (the day of handover of the goods by us to the shipping company), which is only an approximate deadline (ca.-deadline). If no shipping date is specified, goods marked as "in stock" will be shipped no later than the fifth working day, and all other goods within three weeks.

II.10.1. Unless otherwise expressly agreed, we determine the appropriate shipping method and carrier at our sole discretion.

II.10.2. We are only responsible for the timely and proper delivery of the goods to the transport company and are not liable for any loss, damage, or delays caused by the transport company.  
Any shipping time mentioned on egun is therefore non-binding.

II.10.3. If the customer is a consumer, the risk of accidental loss, accidental damage, or accidental loss of the delivered goods passes to the customer at the time the goods are delivered to the customer or the customer is in default of acceptance. In all other cases, the risk passes to the customer upon delivery of the goods to the carrier.

 

II.11. Purchase of firearms, ammunition and powder

II.11.1. Free weapons and ammunition may only be handed over to persons who have completed their 18th year of life. Therefore, a sale and delivery are only possible upon presentation of a certificate or upon presentation of an official confirmation that the buyer has completed their 18th year of life. For the acquisition-required weapons/ammunition, an appropriate official permit is required. Described in detail under Point I.3.


II.11.2. The handling of weapons or ammunition listed in Annex 2 (Weapons List) Section 2 of the Weapons Act requires authorization. Such weapons and ammunition are therefore only sold and transferred upon presentation of corresponding valid documents (e.g., hunting license, weapons possession card, ammunition acquisition certificate, or an exemption permit from the competent authority) in original or as officially (official or notarized) certified copies of all labeled pages.

II.11.3. The handling of weapons or ammunition listed in Annex 2 (Weapons List) Section 1 of the Weapons Act is fundamentally prohibited. Such weapons and ammunition are therefore only sold and transferred upon presentation of an appropriate exemption permit from the competent authority in the original or as officially (officially or notarized) certified copies of all labeled pages. Further explanations can also be found  
under point I.3.  

II.12. Applicable Law, Jurisdiction and Final Clause

II.12.1. The purchase contract between us and the customer is subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, subject to mandatory international private law provisions.

II.12.2. If the customer is a merchant within the meaning of § 1 (1) of the German Commercial Code (HGB), a legal entity under public law or a public-law special fund, the courts in Aachen shall have exclusive jurisdiction for all disputes arising from or in connection with the relevant contractual relationship. In all other cases, we or the customer may bring an action before any court with jurisdiction under statutory provisions.

II.12.3. Should any provision of these General Terms and Conditions be or become ineffective, contain an impermissible time limit, or contain a gap, the legal validity of the remaining provisions shall remain unaffected. Insofar as the ineffectiveness does not result from a violation of §§ 305 et seq. BGB (applicability of General Terms and Conditions), a valid provision shall be deemed agreed in place of the ineffective provision that comes closest to the economic intent of the contracting parties. The same applies in the case of a gap. In the event of an impermissible time limit, the legally permissible measure shall apply.
