General Terms and Conditions

§ 1 Scope of the Contract
The following terms govern the contractual relationship between the seller

and to the respective buyer on the eGun online sales platform.

§ 2 Vertragsgegenstand
The subject of the respective contract is the sale of goods by the seller to the buyer on the eGun sales platform, in particular the sale of hunting & sporting weapons & hunting optics.

These goods are offered by the seller either via his eGun-Shop as shop items or as general auction items. General auction items are visible both on the general eGun-Website and in the seller's eGun-Shop.

The goods listed on the general eGun website or in the seller's eGun shop are binding offers from the seller to conclude a contract for the respective item.

§3 Formation of the Contract

(1) The subject of the contract is the sale of goods.

(2) If an item is posted by us on eGun, the activation of the offer page on eGun constitutes the binding offer to conclude a purchase contract under the conditions stated on the article page.

(3) For the conclusion of the contract, the eGun General Terms and Conditions apply, in particular the provisions under "Conclusion of a Contract", a corresponding link is located at the bottom of every eGun page.
The conclusion of the contract is regulated as follows:

"Conclusion of a Contract"
Users who place an item on the eGun website for online auction are making a binding offer. The seller sets a deadline during the listing process within which the offer can be accepted by a bid. The offer is accepted when a bidder submits a bid. The bid expires if another bidder submits a higher bid. At the end of the auction period, a contract is concluded between the seller and the highest bidder for the purchase of the item listed on eGun. The agreed-upon price is understood to be the gross price (i.e., including VAT). There is also the possibility to offer items on the eGun website with the "Buy Now" (fixed price) option. In this case, a contract is concluded by the immediate purchase of the item. This purchase is independent
from the end of the auction period. This option is only available as long as the item has not yet been bid on. If contract processing between the seller and bidder fails, eGun will offer the item to the second-highest bidder within an automatic process, so that the contract can still be successfully concluded.

(4) Clicking the "SofortKauf", "Jetzt Bieten", or "Vorschlag" buttons on the item pages does not yet result in binding contractual declarations. The customer still has the option to review their entries and correct them or cancel the purchase via the "Zurück" button of the internet browser even after that. The customer enters into a binding agreement and the contract comes into effect through a specific action. With the "Immediate Purchase" option, the buyer submits a binding contractual declaration by clicking the "Buy!" button, which accepts the purchase offer and finalizes the contract. With the "Auction" option, the buyer submits a binding bid by clicking the "Place Bid!" button, which finalizes the contract as long as the buyer is the highest bidder at the auction's end.

(5) The order processing and transmission of all information required for the contract conclusion are done via email, partly automatically. Therefore, you must ensure that the email address you provided to us is correct, that the reception of emails is technically ensured, and especially that it is not prevented by spam filters.

 

§4. Vertragssprache / Vertragstextspeicherung

(1). The contract language is German.

(2). The complete contract text will not be stored by us. Before submitting the order, the contract data can be printed or saved electronically using the browser's print function. After receiving the order, the order data, the legally required information for distance contracts, and the General Terms and Conditions will be sent to you again by email.

§ 5 Widerrufsrecht

You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. In the case of a contract for multiple goods that you have ordered in a single order and which are delivered separately, the revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

Withdrawal consequences

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which the notice of your withdrawal from this contract is received by us.

For repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will we charge you fees for this repayment.
We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must send back the goods or hand them over to us immediately and in any event no later than fourteen days from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. Please send the goods to the address:

We bear the costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling the goods in a way that goes beyond what is necessary to ascertain their condition, properties, and functioning.

 

Exclusion or expiration reasons:

- for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer

- for the delivery of goods that can spoil quickly or whose expiration date is quickly exceeded

The right of withdrawal expires prematurely in the case of contracts

  § 6 Warranty, Liability
The seller's warranty in the event of a defect in the goods and the seller's liability for damages are governed by statutory provisions.

§ 7 Right of Retention, Reservation of Title

(1) A right of retention can only be exercised by you insofar as it concerns claims from the same

§ 9 Schlussbestimmungen
Applicable to the present General Terms and Conditions and to the respective concluded purchase contract is exclusively German law.
