§ 1 Allgemeines

Floba Jagd acts as a travel intermediary for hunting trips. The offered trips are therefore only mediated by Floba Jagd between the traveler and the organizer or hunting area. For competition law reasons, we name the respective organizer or hunting area only upon request or upon booking. The hunting trips mediated by Floba Jagd are carried out by the respective organizer or hunting area under their own responsibility. This includes obtaining any necessary official permits.

The same applies to the mediation of individual travel services such as travel cancellation insurance, rental cars, hotel bookings, flights, ship passages, train and bus travel, etc.

Since Floba Jagd acts only as an intermediary, contractual legal relationships beyond the mediation order exist exclusively between the traveler and the tour operators or other service providers designated in the contract, as well as the laws of the respective country.

The mediation order becomes effective as soon as Floba Jagd or the organizer confirms the trip in writing to the traveler.

§ 2 Zahlungsbedingungen

The payment obligations arising for the traveler in accordance with the order confirmation are to be fulfilled directly to Floba Jagd, unless otherwise agreed. The corresponding payment terms and deadlines are provided to the traveler with the hunting and travel confirmation. As a rule, the traveler pays the costs of the hunting trip directly to the organizer according to the organizer's payment terms.

The booking and/or processing fee is invoiced by Floba Jagd. It includes the costs incurred from the processing and mediation and is owed even if the traveler withdraws from the contract.

Without complete and timely payment of the booking fee, deposit or travel price, the traveler is neither entitled to the handover of travel documents nor to participation in the hunting trip.

If the hunting costs are stated in a foreign currency, they must be paid to the organizer in the local currency. The traveler is responsible for the timely receipt of payment by the organizer.

§ 3 Haftung

In the scope of the mediation contract, Floba Jagd is liable for the proper mediation, but not for the services to be provided by the tour operator and other service providers. Information provided by Floba Jagd about the trip is based solely on the information from the tour operators or service providers. Consequently, the information is only passed on to the traveler. For the contract with the tour operator or service provider, their information is decisive.

A hunting trip can only be compared to other trips to a limited extent. Therefore, travelers must accept deviations from the description of the trip and individual services in the brochure or offer within reasonable limits.

In no case is Floba Jagd liable for the hunting success of the traveler. A guarantee for the quality of the game to be hunted and the hunting success cannot be provided, so that any claims for damages are excluded. Participants in hunting trips assume full responsibility for all risks and dangers associated with a hunting trip. Every shot is taken at the risk of the traveling hunter. If the traveling hunter kills a piece of game not approved by the hunting leader/hunting guide, he must expect a significantly higher hunting fee and legal consequences of the hunting country.

The traveler is obligated to report any complaints on site and request remedial action. Should no resolution be achieved, the complaint must be recorded in a protocol to be signed by the hunting guest and the organizer.

§ 4 Cancellation by the Tour Operator

The tour operator may withdraw from the contract before the start of the trip if the execution of the trip is made more difficult, endangered, or impossible due to unforeseeable events and force majeure, such as war, strikes, riots, epidemics, official orders, natural disasters, significant weather influences, and the like. If no appropriate alternative offer can be made to the traveler, any advance payments already made will be refunded.

§ 5 Cancellation by the Traveler

A cancellation of the trip by the traveler is possible and must always be made in writing. The traveler is, however, free to transfer their booked hunting trip to a third party. This person must travel at the same time and under the same hunting program. Additionally, the requirements of the hunting offer must be met.

If no replacement hunter can be named, the following costs will be incurred by the traveler in case of cancellation:

• 50% of the base costs for trip cancellation up to 60 days before the trip begins.
• 100% of the base costs in case of cancellation less than 60 days before the start of the trip.
• 
  Should the tour operator's contract specify different cancellation terms, these shall apply.

§ 6 Early Termination of the Trip

Should the traveler, for whatever reason, cancel their trip prematurely, the full travel price must be paid in any case. All additional costs for ticket changes, hotel reservations, extra transfers, and the like must be borne by the traveler in this case.

§ 7 Trophäen

Transport and preparation of trophies and their import or export, as well as the acquisition of the necessary documents, are not services provided by Floba Jagd. However, we are of course happy to assist. The traveler must fulfill official requirements themselves. The evaluation of trophies is carried out exclusively according to the conditions of the travel country and the organizer. Claims or objections from the traveler on this matter have no effect against Floba Jagd.

§ 8 Versicherung

Travel insurance is not included in the travel price. It is recommended that the traveler take out travel cancellation insurance. The hunting guest is responsible for ensuring their own insurance coverage. Floba Jagd assumes no liability for any damage caused by the hunting guest, the organizer, or other service providers during the trip and the hunt.

§ 9 Hunting regulations of the host country

The traveler is obligated to acknowledge the regulations binding in the hunting country. This also applies to the evaluation of trophies.

The traveler must be in possession of a valid hunting license from the respective hunting country as well as the corresponding insurance coverage, or obtain them in good time before departure. The same applies to the firearm import permit and any vaccination certificates for hunting dogs.

§ 10 Bookings for multiple persons

If a traveler books for multiple persons, they are considered the authorized representative of the registered individuals and are personally liable for the proper fulfillment of the contract by these individuals.

§ 11 Sonstiges

The ineffectiveness of individual provisions in the mediation contract as well as the general terms and conditions underlying the mediation contract shall not result in the ineffectiveness of the contract or the general terms and conditions. The provision that comes closest to the purpose of the ineffective provisions shall replace the ineffective provisions.

§ 12 Amendment of these GTC and Severability Clause Floba Jagdversand reserves the right to amend these GTC at any time and without cause. Should any of these GTC be ineffective, the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by one of the applicable law that comes closest to it in legal and economic terms. The same applies to any regulatory gaps.
 

§ 13 Sicherheit

When placing an order, your personal data such as name, address, and date of birth will be stored in our computer system. A flawless shop is our dream. Unfortunately, errors can never be completely avoided. Therefore, we must reserve the right to make mistakes, technical changes, and improvements.
