General Terms and Conditions


II.1. Geltungsbereich

II.1.1. For all contracts concluded via the auction platform www.egun.de (hereinafter referred to as "egun") between us, Collector - Guns NL Verl, and you (hereinafter also "Customer"), exclusively the following General Terms and Conditions ("AGB") in the version valid at the time of order or auction shall apply. The customer declares his agreement with the validity of these AGB upon placing a bid, but at the latest upon ordering or auctioning goods via egun. These are the subject matter of the contract.  

 
II.1.2. The product offer on egun is equally aimed at consumers and entrepreneurs. For the purposes of these GTC, (i) a consumer is any natural person who concludes the contract for a purpose that cannot be attributed to their commercial or self-employed professional activity (§ 13 BGB) and (ii) an "entrepreneur" is a natural or legal person or a legally capable partnership that acts in the exercise of their commercial or self-employed professional activity when concluding the contract (§ 14 (1) BGB).

 

II.2. Order Placement and Contract Conclusion

Our product offers on egun represent a non-binding invitation to place a binding order or bid for goods at Firma Collector - Guns NL Verl. By clicking a button such as "Immediate Purchase", "Place Bid!", etc., the customer submits a binding offer to purchase the described goods. Collector - Guns NL Verl will immediately confirm the receipt of the customer's order or bid. This automatically generated confirmation of receipt does not constitute acceptance of the offer. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged fees for this repayment. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract. You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties, and functionality.

II.4. Eigentumsvorbehalt

Until full payment is received, the goods delivered to the customer remain the property of Collector - Guns NL Verl ("reserved goods"). You may not sell or pledge this reserved goods to third parties and must treat them properly and carefully. You must notify us immediately of any third-party access to the reserved goods upon becoming aware of it. The customer is liable for all costs incurred to lift such access, in particular by filing a third-party opposition action, unless the costs are recoverable from the third party concerned.

II.5. Gewährleistung

II.5.1. If the delivered goods are defective, the customer can initially demand from us the elimination of the defect or the delivery of defect-free goods; if the customer is an entrepreneur, we can choose between the elimination of the defect or the delivery of a defect-free item. The choice can only be made by notification in text form (including by e-mail) to the customer within three working days after notification of the defect. We can refuse the type of supplementary performance chosen by the customer if this is only possible at disproportionate costs.

II.5.2. If the subsequent performance according to Section 5.1 fails or is unreasonable for the customer or we refuse the subsequent performance, the customer is entitled, as applicable under applicable law, to withdraw from the purchase contract, reduce the purchase price or claim damages or reimbursement of their futile expenses. For the customer's claims for damages, the special provisions of Section 6 of these GTC also apply.

II.5.3. The warranty period is two years and one year from delivery for used goods, if the customer is a consumer, otherwise one year from delivery.

II.5.4. Only for business customers, the following applies: The customer must inspect the goods carefully immediately after delivery. The delivered goods are considered approved by the customer if a defect is not notified to us (i) in the case of obvious defects within five working days of delivery or otherwise (ii) within five working days of discovering the defect.

 

II.6. Haftung

II.6.1. Collector - Guns NL Verl is liable without limitation

                  - in case of intent or gross negligence,
                  - for the violation of life, body or health
    (this only applies if this product was manufactured by us ourselves -
    for the foreign-made products such as weapons and ammunition, the manufacturer is liable  
    this one)
                  - in accordance with the provisions of the Product Liability Act as well as                  
                - as part of a warranty taken over by Collector - Guns NL Verl.

II.6.2. Without prejudice to the provision in Section 6.1, Collector - Guns NL Verl is liable for negligence only in the case of breach of contractually essential obligations, i.e., the breach of obligations whose fulfillment is essential for the proper execution of the contract and on which the customer may regularly rely ("cardinal obligation"). In the case of a slightly negligent breach of a cardinal obligation, the liability of Collector - Guns NL Verl is limited to such typical damages and/or such typical scope of damages that were foreseeable at the time of the conclusion of the contract.

II.6.3. The above limitations of liability also apply in the event of fault by an agent of Collector - Guns NL Verl, as well as for the personal liability of employees and representatives of Collector - Guns NL Verl.

II.6.4. Die Verjährung von Schadensersatzansprüchen des Kunden aufgrund Haftung wegen Vorsatzes bemisst sich nach den gesetzlichen Vorschriften. Die Verjährungsfrist hinsichtlich sonstiger Schadensersatzansprüche des Kunden beträgt ein Jahr. II.7. Datenschutz

II.8.Prices and Payment

II.8.1. Unless otherwise agreed in individual cases, all deliveries from Collector - Guns NL Verl are based on the prices quoted on egun on the day of the order or auction. Our prices include the statutory value added tax (either including 19% statutory VAT or difference tax-
tax under § 25a USTG). To this are added the shipping costs mentioned in the order or auction. Customs duties and similar charges are to be borne by the customer.

II.8.2. We deliver to regular customers on account (sent via email and may also be included in our acceptance). Invoices are due immediately upon receipt by the customer and must be paid in full and without deduction to the account of Collector - Guns NL Verl as stated in the invoice, within a maximum of seven days.
 
II.8.3. We reserve the right to only accept prepayment or cash on delivery for first-time orders.

II.8.4. The customer has no right of set-off or retention, unless the counterclaim is undisputed or legally established.

 

II.9. Dispatch of the Goods

II.9.1. We will ship the goods to the customer no later than the shipping date specified during the order or auction on the respective offer page (the day of handover of the goods by us to the shipping company), which is only approximate (ca.-deadline). If no shipping date is specified, goods marked as "in stock" will be shipped no later than the fifth working day, and all other goods within three weeks.

II.10.1. Unless otherwise expressly agreed, we determine the appropriate shipping method and carrier at our sole discretion.

II.10.2. We are only responsible for the timely and proper delivery of the goods to the carrier and are not liable for any loss, damage, or delays caused by the carrier.  
Any shipping time mentioned on egun is therefore non-binding.

II.10.3. If the customer is a consumer, the risk of accidental loss, accidental damage, or accidental loss of the delivered goods passes to the customer at the time the goods are delivered to the customer or the customer is in default of acceptance. In all other cases, the risk passes to the customer upon delivery of the goods to the carrier.

 

II.11. Purchase of firearms, ammunition and powder

II.11.1. Free weapons and ammunition may only be handed over to persons who have completed their 18th year of life. Therefore, a sale and delivery are only possible upon presentation of a document or upon presentation of an official confirmation that the buyer has completed their 18th year of life. For the acquisition-required weapons/ammunition, an appropriate official authorization is required. Described in detail under Point I.3.


II.11.2. The handling of weapons or ammunition listed in Annex 2 (Weapons List) Section 2 of the Weapons Act requires authorization. Such weapons and ammunition are therefore only sold and transferred upon presentation of corresponding valid documents (e.g., hunting license, weapons possession card, ammunition acquisition certificate, or an exemption permit from the competent authority) in original or as officially (official or notarized) certified copies of all labeled pages.

II.11.3. The handling of weapons or ammunition listed in Annex 2 (Weapons List) Section 1 of the Weapons Act is generally prohibited. Such weapons and ammunition are therefore only sold and transferred upon presentation of an appropriate exemption permit from the competent authority in the original or as officially (notarized or certified) copied pages of all labeled pages. II.12. Applicable Law, Jurisdiction and Final Clause

II.12.1. The purchase contract between us and the customer is subject, subject to mandatory international private law provisions, to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

II.12.2. If the customer is a merchant within the meaning of § 1(1) of the German Commercial Code (HGB), a legal entity under public law, or a public-law special fund, the courts in Aachen shall have exclusive jurisdiction for all disputes arising from or in connection with the relevant contractual relationship. In all other cases, we or the customer may bring an action before any court with jurisdiction under statutory provisions.

II.12.3. Should any provision of these General Terms and Conditions be or become ineffective, contain an impermissible time limit, or contain a gap, the legal validity of the remaining provisions shall remain unaffected. Insofar as the ineffectiveness does not result from a violation of §§ 305 et seq. BGB (applicability of General Terms and Conditions), a valid provision shall be deemed agreed in place of the ineffective provision, which comes closest to the economic intent of the contracting parties. The same applies in the case of a gap. In the event of an impermissible time limit, the legally permissible measure shall apply.
